Safeguarding guidance and legislation for Wales

This page provides links to relevant strategy, guidance, statistics and legislation that is specific to children and young people in Wales. Please contact the NSPCC Cymru/Wales Policy Team if you need any further information.

Introduction

The devolution of legislative power from the UK Parliament at Westminster to the National Assembly for Wales is a gradual and ongoing process.

The Government of Wales Act 1998 gave the Welsh Assembly responsibility for producing regulations and guidance relating to child protection, although the Acts themselves were still being made in Westminster.

The Government of Wales Act 2006 gave the Welsh Assembly power to request legislative competence from Westminster to pass its own laws, called Assembly Measures, in 20 specific policy areas including social welfare.

On 10 December 2008, the National Assembly for Wales (Legislative Competence) (Social Welfare and Other Fields) Order 2008 was given Royal Assent, which means the Welsh Assembly will now be responsible for making laws (in the form of Assembly Measures) for matters relating to child protection and safeguarding.

Children and young people: rights to action
2004. Sets out the Welsh Assembly Government's aim to support all children and young people to achieve their potential and commitment to assisting children and young people who are disadvantaged, for example through disability, poverty, family and community circumstances, illness, neglect or abuse. It includes reference to the Seven Core Aims and the explicit link between these and the United Nations Convention on the Rights of the Child (UNCRC).

National service framework (NSF) for children, young people and maternity services
2005. The overall aim of the Children's NSF is that "all children and young people achieve optimum health and well being and are supported in achieving their potential".

Tackling domestic abuse: the all Wales strategy
2005. The strategy’s primary objective is to provide the much-needed structural ‘backbone’ to direct domestic abuse intervention across Wales. It aims to facilitate the development and implementation of a ‘joined-up’ problem-solving approach which addresses domestic abuse holistically.

Fulfilled lives, supportive communities: a strategy for social services in Wales over the next decade
2007. The Strategy sets out the policy direction for social services for the next 10 years.

School based counselling services in Wales: a national strategy
2008. This document sets out the Welsh Assembly Government’s strategy for developing school-based counselling services for children and young people that are of a high standard.

2008 Children and young people’s well-being monitor for Wales

The 2008 Monitor focuses on the well-being of children and young people aged 0 to 18 years in Wales, with a view to providing a holistic picture of their lives. It pulls together statistics and research from a range of different sources and reports on a variety of child well-being indicators.
